These Terms and Conditions apply to all registrations, bookings and participation in workshops, masterclasses, training programmes and other professional activities organised under FEST FILM LAB by FEST – Associação Cultural, NIF 507115180, Portugal (“FEST”, “FEST FILM LAB”, “we”, “us” or “the Organisation”).
By completing a registration or making payment for a FEST FILM LAB activity, the participant confirms that they have read, understood and accepted these Terms and Conditions.
1. Registration and Acceptance of Terms
It is the responsibility of the participant to review all information concerning the workshop, including dates, location, format, programme, trainer, price and these Terms and Conditions, before completing the registration.
A registration constitutes acceptance of the Terms and Conditions applicable at the time the registration is made.
Participants are responsible for ensuring that the information supplied during registration is accurate and complete and must inform FEST FILM LAB as soon as reasonably possible of any relevant error.
2. Confirmation of Registration
A registration is only considered confirmed after FEST – Associação Cultural has received the full amount due, unless FEST has expressly confirmed otherwise in writing.
Submission of a registration form, expression of interest, reservation request or incomplete payment does not, by itself, guarantee a place.
For registrations processed through the FEST FILM LAB website, the payment and registration confirmation issued by the system constitutes evidence that the registration has been received and confirmed.
3. Prices, Currencies and Payment
Workshop prices are displayed in the currency applicable to each individual workshop.
A workshop may be offered in EUR, GBP, USD, AED or another currency expressly displayed on its registration page.
Where an early-bird, promotional or reduced price is offered, eligibility depends on payment being completed within the stated promotional period.
Any currency conversion fees, bank fees, card charges or other costs imposed by the participant’s bank, payment provider or financial institution are the responsibility of the participant.
4. Registrations Are Final and Non-Refundable
Except where expressly stated otherwise in these Terms or where reimbursement is required by mandatory applicable law, all registrations are final and non-refundable.
FEST FILM LAB does not provide refunds because a participant becomes unable or chooses not to attend a workshop.
This includes, without limitation, absence or cancellation by the participant due to:
- professional or employment commitments;
- personal or family circumstances;
- illness or health circumstances;
- changes of personal plans;
- travel difficulties;
- flight delays or cancellations;
- airport closures;
- visa refusal, delay or inability to obtain a visa;
- strikes or industrial action;
- adverse weather;
- transport disruption;
- accommodation problems;
- financial circumstances;
- or any other circumstance affecting the participant’s ability to attend.
Failure to attend all or part of a workshop does not create any right to reimbursement, compensation or credit.
5. Transfers and Changes of Participant
Registrations are personal and may not be resold, commercially transferred or otherwise assigned without the prior agreement of FEST FILM LAB.
Where possible and reasonable, FEST FILM LAB may, at its sole discretion, permit another person to attend in place of the originally registered participant.
Any such change must be requested in advance and expressly accepted by FEST FILM LAB.
FEST is under no obligation to accept a change of participant.
Any transfer, credit, exception, postponement or other accommodation offered by FEST in a particular case is a discretionary goodwill arrangement. It does not create a contractual entitlement, does not establish a precedent and does not oblige FEST to offer the same arrangement in any other case.
6. Changes to Dates and Timetables
Participants acknowledge that FEST FILM LAB workshops are delivered by active professionals working in the film, television and audiovisual industries and that professional schedules, productions, travel arrangements and other circumstances may occasionally require changes.
FEST FILM LAB therefore reserves the right, where reasonably necessary, to alter workshop dates, starting or finishing times, daily schedules or other timetable arrangements.
Such changes may result from, among other circumstances:
- changes in the professional schedule of the trainer;
- film, television or audiovisual production commitments;
- travel disruption;
- flight changes or cancellations;
- illness;
- venue availability;
- technical or operational requirements;
- circumstances affecting the safe or practical delivery of the workshop;
- or other circumstances beyond the Organisation’s reasonable control.
Changes to dates or timetables will not constitute grounds for reimbursement.
Where a workshop is rescheduled, the participant’s registration will automatically remain valid for the rescheduled workshop.
FEST will make reasonable efforts to inform registered participants of relevant changes as soon as reasonably practicable.
7. Changes to Trainers, Programme or Workshop Arrangements
FEST FILM LAB reserves the right, where reasonably necessary, to make changes to the programme, curriculum, structure, venue or operational arrangements of a workshop.
Where a trainer becomes unavailable due to illness, professional commitments, travel difficulties or another relevant circumstance, FEST may:
- reschedule the workshop;
- modify the timetable;
- adapt the workshop programme;
- or, where appropriate, appoint another suitable professional.
Such changes do not automatically constitute cancellation of the workshop and will not, by themselves, constitute grounds for reimbursement.
FEST will make reasonable efforts to preserve the professional level, purpose and overall nature of the programme originally advertised.
8. Cancellation by FEST FILM LAB
If FEST FILM LAB cancels a workshop entirely and does not provide a rescheduled date or an alternative delivery of the workshop, registered participants will be entitled to reimbursement of the registration fee paid.
The liability of FEST in such circumstances is limited to the amount actually paid to FEST for the workshop, except where mandatory applicable law provides otherwise.
FEST is not responsible for reimbursing flights, accommodation, visas, transport, meals, loss of income, production costs or any other direct or indirect expenses incurred by the participant in connection with attendance.
Participants are therefore strongly advised not to make non-refundable travel arrangements and to obtain appropriate travel insurance.
9. Circumstances Beyond FEST’s Reasonable Control
FEST FILM LAB shall not be responsible for failure, delay, interruption or alteration of a workshop resulting from circumstances outside its reasonable control.
These may include, without limitation:
war or threat of war; terrorism; civil disturbance; riot; government action; industrial disputes; strikes; airport or transport shutdowns; flight cancellations; natural disasters; fire; floods; extreme or adverse weather conditions; epidemics or public-health emergencies; restrictions imposed by public authorities; interruption of utilities or communications; major technical failures; or comparable events.
Where such circumstances affect the planned delivery of a workshop, FEST may take reasonable measures including postponement, rescheduling, changes of timetable, changes of venue or adaptation of the manner in which the programme is delivered.
Where the workshop is rescheduled rather than cancelled, the registration will remain valid and the change will not constitute grounds for reimbursement, except where mandatory applicable law requires otherwise.
10. Travel, Accommodation and Visas
Participants are entirely responsible for organising and paying for their own travel, accommodation, visas, entry permissions, insurance and other arrangements necessary to attend a workshop.
Registration for a FEST FILM LAB workshop does not constitute a guarantee that a visa, travel authorisation or other entry permission will be granted.
Visa refusal, delays in obtaining travel documents or inability to travel do not entitle the participant to a refund.
Where appropriate, FEST may provide reasonable documentation confirming registration in a workshop, but FEST assumes no responsibility for the outcome of any visa or immigration application.
Participants are strongly advised to use flexible or refundable travel arrangements whenever possible.
11. Health and Travel Insurance
Participants are strongly advised to obtain adequate travel and health insurance covering, as appropriate:
- illness or injury;
- inability to travel;
- flight cancellation or disruption;
- emergency medical treatment;
- loss or theft of personal property;
- accommodation disruption;
- and other risks associated with international travel and participation in an event.
The decision to travel and participate remains the responsibility of the participant.
12. Personal Property, Health and Liability
Participants remain responsible for their own personal property and belongings throughout the workshop.
FEST is not responsible for illness, injury, loss, theft or damage arising from circumstances outside its reasonable control, except where liability cannot lawfully be excluded or limited.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
13. Participant Conduct
FEST FILM LAB is committed to maintaining a professional and respectful working environment.
FEST reserves the right to refuse admission to, or remove from a workshop, any participant whose behaviour is reasonably considered:
- abusive;
- threatening;
- discriminatory;
- harassing;
- violent;
- seriously disruptive;
- intoxicated to an extent that affects the workshop;
- disrespectful towards trainers, staff or other participants;
- or otherwise incompatible with the safe and professional operation of the workshop.
The same applies to possession of illegal substances or objects that may reasonably be regarded as weapons or present a safety risk.
A participant removed or refused admission for such reasons will not be entitled to reimbursement.
14. Intellectual Property and Workshop Materials
Unless otherwise stated, all workshop materials supplied by FEST FILM LAB or by trainers remain the intellectual property of their respective owners.
Registration grants the participant a personal, non-transferable right to use materials supplied for their own professional development.
Workshop materials may not be reproduced, published, distributed, sold, made publicly available or used for commercial training purposes without prior permission from the relevant rights holder.
15. Recording
Participants may not audio-record, video-record, livestream or otherwise reproduce a workshop, in whole or in substantial part, without prior authorisation from FEST FILM LAB and, where appropriate, the trainer.
FEST may itself photograph, film or document certain activities. Where such recording is intended for promotional or communication purposes, the applicable information and permissions will be handled separately where required.
16. Confidentiality and Professional Discussions
Some workshops involve discussion of projects, scripts, concepts, business plans or other professional material belonging to participants or trainers.
Participants are expected to respect the confidential and professional nature of such exchanges and should not disclose another participant’s unpublished material without permission.
Unless expressly agreed otherwise, FEST does not assume responsibility for policing or guaranteeing the confidentiality of ideas or materials voluntarily shared by participants during a workshop.
Participants should exercise appropriate professional judgement when deciding what material to disclose.
17. Online Workshops
Where a programme is delivered online, participants are responsible for ensuring that they have:
- a suitable internet connection;
- compatible equipment;
- functioning audio and video where required;
- and access to any software communicated in advance.
Problems affecting an individual participant’s equipment, internet connection, software or local infrastructure do not constitute grounds for reimbursement.
FEST will make reasonable efforts to address significant technical failures within systems under its direct control.
18. Right of Withdrawal and Consumer Rights
FEST FILM LAB does not grant participants a contractual cooling-off or cancellation right beyond any rights that may be mandatory under applicable law.
Certain contracts for services connected with activities scheduled for a specific date or period, and other categories of service defined by applicable consumer law, may be excluded from a statutory right of withdrawal.
Where the applicable law provides that no statutory right of withdrawal exists for the relevant booking, the participant acknowledges that the registration becomes binding upon completion and payment and that there is no right to cancel the registration simply by changing their mind.
Where mandatory law grants a participant a statutory right of withdrawal that cannot validly be excluded, that statutory right remains unaffected by these Terms.
Where a participant expressly requests that a service, preparatory session, online component or other performance begin during a statutory withdrawal period, FEST may request any consent or acknowledgement required by applicable law.
Nothing in these Terms is intended to deprive a consumer of rights that cannot lawfully be waived.
19. Resale and Unauthorised Commercial Use
Registrations may not be resold for profit or offered through unauthorised resale channels.
FEST may invalidate a registration that has been obtained or resold through fraudulent, unlawful or unauthorised means.
No reimbursement will be due to a person participating in or benefiting from an unlawful or fraudulent resale.
20. Payment Disputes and Chargebacks
Participants should contact FEST FILM LAB before initiating a payment dispute or chargeback so that any genuine payment or registration issue can be investigated.
Initiating a chargeback does not itself create a right to reimbursement where the registration is valid and the service remains available in accordance with these Terms.
FEST reserves the right to provide the payment provider with registration records, transaction records, acceptance of these Terms and relevant correspondence in response to a payment dispute.
21. Communications
Participants are responsible for providing a valid email address and for monitoring communications relating to their registration.
FEST FILM LAB may use the email address supplied during registration to send essential information concerning the workshop, including confirmation, logistical information, timetable information and changes affecting the event.
Participants are advised to add FEST FILM LAB email addresses to their contacts or safe-sender list and to check spam or junk folders.
Failure to read an email properly sent to the address supplied during registration does not, by itself, create a right to reimbursement.
22. Changes to These Terms
FEST may update these Terms and Conditions from time to time.
Unless required otherwise by law, changes will apply to registrations made after the revised Terms are published.
The contractual terms applicable to an existing registration are generally those accepted when that registration was made, subject to any changes required by mandatory law or specifically agreed with the participant.
23. Governing Law
These Terms and any contractual relationship between FEST – Associação Cultural and the participant are governed by Portuguese law.
Where legally permitted, disputes arising from these Terms or from participation in a FEST FILM LAB activity shall be subject to the jurisdiction of the competent Portuguese courts.
Nothing in this provision restricts any mandatory jurisdictional protection that applicable law grants to a consumer.
24. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the maximum extent permitted by law.
Where this is not possible, the affected provision shall be considered severed without affecting the validity of the remaining Terms.
